8. Dispute Resolution 8.1. If a dispute arises out of or relates to these Terms, the parties must not commence court proceedings unless the following process has been followed. 8.2. Within 30 days of the notice, both parties must endeavour in good faith to resolve the dispute by negotiation. If unresolved after 30 days, the parties must agree on a mediator or request one be appointed by the President of the Australian Mediation Association. Mediation will be held in Victoria, Australia. 8.4. All communications concerning dispute resolution are confidential and treated as "without prejudice." 8.5. If the dispute remains unresolved after 2 months of mediation, either party may request the mediator terminate the mediation.
9. Venue and Jurisdiction This Website is intended to be viewed by residents of Australia. Any dispute shall be resolved exclusively in the courts of Victoria, Australia.
10. Governing Law These Terms are governed by the laws of Victoria, Australia.
